Terms of Service

1. Agreement

These Terms apply to your use of the LuxeZar Tech website and to services supplied by LuxeZar LLC under the LuxeZar Tech division. By using the website, submitting an enquiry, approving a quotation, paying an invoice or ordering a service, you agree to the applicable terms. A quotation, order confirmation, Statement of Work or signed agreement may contain additional project terms. If there is a direct conflict, the specifically accepted project document controls except where mandatory law requires otherwise.

2. Business authority

You confirm that submitted information is accurate and that you are authorized to request work, approve access, accept a quotation and bind the stated business where applicable. You must not request work on systems, accounts, domains or data you are not authorized to control.

3. Service scope, billing cadence and starting prices

The service page and accepted project documents define the scope. Anything not expressly included is excluded. Each service page identifies whether the LuxeZar Tech fee is one-time or monthly. A price marked “from,” “starting” or “estimated” applies only to the stated starter scope. The final price may change with users, devices, mailboxes, data size, source platform, integrations, features, licences, deadlines, compliance requirements and customer responsibilities. Custom work begins only after written scope and price approval.

4. Customer responsibilities

You must provide accurate information, timely decisions, required content, authorized access, working licences, backups and an appropriate contact. You remain responsible for business decisions, legal and regulatory requirements, data classification, third-party agreements and review of deliverables. We may pause work where access, payment, information, authorization or safety requirements are incomplete.

5. Security and access

Access must be supplied through an agreed method. Use least-privilege and temporary access where practical, disclose relevant restrictions, and remove or rotate credentials after handover. Do not send passwords, recovery codes, private keys or payment-card data through public forms. We may refuse insecure, unauthorized or unlawful instructions.

6. Fees, taxes and payment

Prices are stated in U.S. dollars unless otherwise shown. You are responsible for applicable taxes, duties, bank charges and currency-conversion costs except taxes imposed on our net income. Payment timing follows the checkout, invoice, quotation or Statement of Work. We may suspend work for overdue amounts. Payment processing is provided by third parties under their own terms.

7. Company IT Audit launch offer

The initial discovery and preliminary triage are free. After discovery, an eligible customer may either purchase the standalone focused Company IT Audit for $149 one-time or approve in writing a qualifying LuxeZar Tech improvement project priced at $299 or more and receive the focused audit at $0. The qualifying project must be approved before the full audit begins. The starter audit covers one primary environment with up to 10 users, is normally delivered within 7–10 business days after complete evidence is received and is offered subject to available audit start slots. The waived $149 fee has no cash value, is non-transferable, cannot be combined with another credit and does not reduce third-party costs. Eligibility, authorization, evidence requirements, framework coverage and scope are confirmed in writing. The audit may benchmark selected observations against ISO/IEC 27001, NIST CSF 2.0, CIS Controls v8 and applicable Microsoft security baselines. It is non-invasive and does not constitute ISO certification, a regulatory attestation, penetration testing, a forensic investigation, legal advice or a security guarantee.

8. Customer-owned third-party products and licences

Unless a written quotation expressly states otherwise, the customer opens, owns and pays Microsoft, WordPress, WooCommerce, hosting, domain, storage, plugin, payment-service, security-tool, app-store, advertising, API and other provider accounts directly. The customer grants only the authorized access required for delivery. LuxeZar Tech’s implementation or management fee is separate from provider charges. We do not hide provider prices or control provider availability, approval, pricing, policy enforcement or product changes.

9. Delivery, capacity, support and acceptance

Delivery dates are estimates unless expressly guaranteed in writing. The delivery period begins when payment or deposit and all required customer inputs are received. Project starts may be scheduled according to available delivery capacity. Each service page states the included post-delivery correction or support period. New features, ongoing monitoring, administration and requests outside that period are not included unless agreed in writing. You must review deliverables within the stated review period. Unreported minor issues do not automatically extend a project indefinitely.

10. Cancellations and refunds

The Service Cancellation and Refund Policy applies unless a signed agreement contains project-specific rules. Completed work, earned milestones, reserved support time, assigned licences and nonrecoverable third-party costs may not be refundable.

11. Intellectual property

Each party retains pre-existing intellectual property. After full payment, you receive the rights or licence to project deliverables stated in the written scope. We retain rights in general methods, know-how, templates, reusable code, tools and non-customer-specific materials. Third-party components remain subject to their licences.

12. Acceptable use

You must comply with the Acceptable Use Policy. We may reject or stop work involving unauthorized access, malware, abuse, fraud, unlawful surveillance, intellectual-property infringement or other harmful activity.

13. Warranties and disclaimers

We will perform services with reasonable care consistent with the agreed scope. Unless expressly stated in writing, services and website information are provided without warranties of uninterrupted operation, error-free results, guaranteed security, guaranteed compliance, guaranteed rankings, guaranteed revenue or compatibility with every third-party system. Cybersecurity reduces risk; it cannot eliminate all risk.

14. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, punitive or consequential damages, or for lost profit, revenue, goodwill, opportunity or data. To the maximum extent permitted by law, LuxeZar LLC’s aggregate liability related to a service will not exceed the fees paid to LuxeZar LLC for the specific service giving rise to the claim during the six months before the event. These limits do not apply where prohibited by law.

15. Indemnity

To the extent permitted by law, you agree to defend and indemnify LuxeZar LLC against third-party claims arising from your unlawful instructions, unauthorized access request, content, data, breach of these terms or violation of third-party rights.

16. Governing law and disputes

Unless a signed agreement states otherwise or mandatory consumer law applies, these terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Before formal proceedings, the parties will attempt in good faith to resolve the dispute through written notice and reasonable discussion.

17. General

If a provision is unenforceable, the remaining provisions continue. Delay in enforcement is not a waiver. You may not assign a project without our written consent except as permitted by law. Electronic acceptance and records may be used. Questions may be sent to contact@tech.luxezarllc.com.
